The issue of worker alienation in the context of business ethics is critically examined. From a normative perspective, it is assumed that the minimal ethical requirement in business should include accountability for adverse consequences of management practice for workers in organizations. Using this standard, managerial actions that are responsible for worker alienation are considered unethical. The nature of work alienation and the organizational conditions responsible for it are outlined. Is an ethical leader an oxymoron? Society demands and expects greater accountability from organizational leaders. The literature on leadership, especially business leadership, has neglected ethical issues by focusing only on those approaches and strategies that emphasize self-centred, individualistic concerns. How ever, true and effective leadership is one in which the leader's behaviour and the exercise of the leadership influence process are consistent with ethical and moral values. Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. Rabindra Kanungo''s position that alienation at work can be eliminated within capitalism is critically evaluated. My argument is that Kanungo only emphasizes the psychological aspect of Marx''s view of alienation. The failure to include the ontological element of alienation results in the confused position that alienation can be eliminated while workers are still being separated from their work by capital. The role that the right to private property plays in the maintenance of this separation is also seen (...) to be a part of Marx''s conception of alienation that is missing from Kanungo''s analysis. The clarification of Marx''s conception of alienation results in the position that organizations within capitalism cannot live up to the moral imperative to be socially responsible in removing alienation at work. The paper highlights the dependence of the level of organizational trust on work ethic and aims to show that development of trust in organizations can be stimulated by raising the level of work ethic with organizational practices. Based on the framework by Kanungo, R. N. and A. M. Jaeger, Management in Developing Countries, pp. 1-23), historical-cultural analysis of the Lithuanian context is carried out. The country is chosen as an example of a post-socialist context where work ethic and trust (...) in the society tended to be rather low. The authors discuss organizational practices, particularly the ones related to people management, which can facilitate development of work ethic, and thus, trust in organizations operating in a post-socialist context. The importance of a processual approach to the development of organizational trust and the ethical content of organizational practices, which are aimed at developing organizational trust is highlighted. The idea of natural law has a long history. It has had different meanings for different people and continues to occupy intellectual engagements as to the connotations of the expression ‘natural law’ in diverse and different contexts. This requires delving deep into the hoarypast and analyzing the gradual development of the idea of natural law through the ages. Understanding natural law necessitates exploring its relation with positive law, its application, and, notably, the import of the word ‘natural’ in the expression (...) ‘natural law’. Be that as it may, there is no denying the fact that there is an element of exclusivity in natural law that has kept it alive and going across generations. Even some of the jurists who adhered to the principles and tenets of legal positivism have shown an inclination towards the principles of natural law, especially as regards the relation between law and morality. It has survived the tests of time. The present paper seeks to explicate the various dimensions of natural law and explore its growth application. (shrink)

Domestic courts have attained prominent status in the international human rights system. While adjudicating individual claims and interpreting legal provisions, domestic courts have conveyed meanings that are integral to the working of the international human rights system. The dynamism of domestic courts is an undeniable quality, through which they incorporate diverse perspectives based on principles linked to individual sovereignty, justice, peace, etc. In this paper, the role of the Indian Supreme Court has been discussed in light of three landmark decisions (...) where the court applies international and domestic human rights standards to substantiate its interpretations. In light of the cases of Navtej Singh v. Union of India, Joseph Shine v. Union of India, and KS Puttaswamy v. Union of India, the paper examines the approach of the court under five broad headings: (a) the domestic context, (b) autonomy and determination, (c) constitutional parameters and validity of laws (d) vulnerability, and (e) other courts and other contexts. On the role of domestic courts in general, the paper outlines a list of the contributions that domestic courts are making in the field of human rights. (shrink)

We live in a period of enormous contradictions, so well reflected in social life as well as in legal discourse. A pluralistic society as diverse as India in this age of globalization is a challenge to both the lawmakers and the courts, with new problems emerging in new avatars with alarming consistency. In the last six decades or so, Constitutional democracy has witnessed some of the unprecedented upheavals both in the social and political life of the nation as well as (...) in the arena of life. Laws have been enacted to deal with emerging problems. Courts have been innovative, and exemplary as regards their judicial courage and craft to uphold rule of law and democracy in a country of billion hopes and aspirations. The present book is an ensemble of contributions from young legal scholars from some of the major legal institutions of India. Scholars have not reached an agreement on a theoretical foundation that underlies the psychological effects of avatar use on users. One group of scholars focuses on the perceptual nature of avatar use, proposing that perceiving the self-being represented by a virtual representation leads to the effects. Another group suggests that social traits in avatars prime users causing them to behave in accordance with the social traits. We combine these two theoretical explanations and present an alternative approach, hinging on a concept (...) of meta-cognitive experience. The psychological mechanism of the avatar-user bond is explicated in terms of cognitive fluency, a type of meta-cognitive experience reflecting an awareness of how readily or easily information is processed. Under this explication, two concepts related to avatar-user bond, identification and embodiment, are understood as the meta-cognitive experience of cognitive fluency at the level of one’s identity and physical body, respectively. Existing empirical evidence on avatar effects is revisited to explore how this new theoretical framework can be applied. (shrink)

In this age of DNA computers and artificial intelligence, information is becoming disembodied even as the "bodies" that once carried it vanish into virtuality. While some marvel at these changes, envisioning consciousness downloaded into a computer or humans "beamed" _Star Trek_-style, others view them with horror, seeing monsters brooding in the machines. In _How We Became Posthuman,_ N. Katherine Hayles separates hype from fact, investigating the fate of embodiment in an information age. Hayles relates three interwoven stories: how information lost (...) its body, that is, how it came to be conceptualized as an entity separate from the material forms that carry it; the cultural and technological construction of the cyborg; and the dismantling of the liberal humanist "subject" in cybernetic discourse, along with the emergence of the "posthuman." Ranging widely across the history of technology, cultural studies, and literary criticism, Hayles shows what had to be erased, forgotten, and elided to conceive of information as a disembodied entity. Thus she moves from the post-World War II Macy Conferences on cybernetics to the 1952 novel _Limbo_ by cybernetics aficionado Bernard Wolfe; from the concept of self-making to Philip K. Dick's literary explorations of hallucination and reality; and from artificial life to postmodern novels exploring the implications of seeing humans as cybernetic systems. Although becoming posthuman can be nightmarish, Hayles shows how it can also be liberating. From the birth of cybernetics to artificial life, _How We Became Posthuman_ provides an indispensable account of how we arrived in our virtual age, and of where we might go from here. (shrink)

This book, the first of its kind, puts forward a novel, unified cognitive account of skeptical doubt. Historically, most philosophers have tried to tackle this difficult topic by directly arguing that skeptical doubt is false. But N. Ángel Pinillos does something different. He begins by trying to uncover the hidden mental rule which, for better or worse, motivates our skeptical inclinations. He then gives an account of the broader cognitive purpose of having and applying this rule. Based on these ideas, (...) he shows how we can give a new response to the traditional problem of global skepticism. He also argues that philosophical skepticism is not just something that comes up during philosophical reflection, as David Hume, Charles Sanders Peirce and other philosophers have urged. Instead, it is of great practical significance. The rule which produces skepticism may itself be operative in certain pathologies such as obsessive-compulsive disorder, in creative endeavors, and in conspiratorial thinking. The rule can also explain some of our reluctance to trust statistical evidence, especially in legal settings. More broadly, this volume aims to breathe new life into a classic problem in philosophy by tackling it from a new perspective and exploring new areas of application. Aims: To describe individuals’ perceptions of the activities that take place within the cancer genetics clinic, the relationships between these activities and how these relationships are sustained. Design: Qualitative interview study. Participants: Forty individuals involved in carrying out cancer genetics research in either a clinical (n = 28) or research-only (n = 12) capacity in the UK. Findings: Interviewees perceive research and clinical practice in the subspecialty of cancer genetics as interdependent. The boundary between research and clinical practice is described (...) as vague or blurred, and this ambiguity is regarded as being sustained by a range of methodological, ethical and economic factors. The implications of these findings for the “therapeutic misconception” are explored. It is argued that while research participation is seen as having therapeutic benefit for individual patients, the interviewees are not labouring under any misconceptions about the relationship between research and clinical care. It is suggested that concepts such as the “therapeutic misconception” may have less relevance in highly technological specialities that are characterised by a developing evidence base. (shrink)

Makalede, Osmanlı bilgini Şemseddin Ahmed b. Musâ el-Ḫayâlî’nin düşüncesi bağlamında değerin imkânı ve fiillere değer yüklemenin kaynağı sorununun incelenmesi amaçlanmıştır. Mu‘tezile ve Eş‘arîler karşısında Hanefî-Mâtürîdî gelenekte değer konusuna yaklaşımın ne olduğu sorusu Hayâlî’nin görüşlerine referansla ele alınmıştır. Hayâlî, kendi düşüncesini, hocası Hızır Bey’in el-Ḳaṣîdetü’n-nûniyye adlı kasidesine yazdığı şerhte ortaya koymuştur. Özellikle bu kasidenin “iyilik ve kötülük şer‘îdir ama/ biz bunların akılla bilinebileceğini söylüyoruz” dizelerinin yorumunda hüsun ve kubuh meselesini incelemiştir. Onun düşüncelerinin analiz edilmesi ve yorumlanmasında Muhammed Ömer b. eş-Şeyh Abdi’l-Celîl (...) b. eş-Şeyh Abdi’l-Cemîl el-Bağdâdî el-Hanefî’nin Ḥavâşî’l-Futûḥiyye li-Şerḥi’n-Nûniyye ve Mehmet Emin Üsküdârî’nin Ḥâşiye ʿalâ Şerḥi Hayâlî ‘ale’l-Ḳaṣîdeti’n-nûniyye adlı eserinden yararlanılmıştır. Eş‘arîler, insan için değer bilgisinin mümkün olmadığını iddia ederek, iyi ve kötü hakkındaki bilgimizin kaynağının din olduğunu kabul etmişlerdir. Mu‘tezilî düşünürler ise iyi ve kötüyü fiillerin zatına ya da fiillerin zatında bulunan sıfatlarla ilişkilendirmişlerdir. Cübbâîler gibi bazı Mu‘tezilî düşünürler, fiillerin yapıldığı bağlamın ve şartların da değer atfetmede önemli olduğunu ifade etmişlerdir. Değer konusunda, Buharalı Hanefî âlimler Eş‘arî değer anlayışına yakın dururken, Mâtürîdîler Mu‘tezilî fikirlere yakın durmuşlardır. Mâtürîdîler, dinin iyi ve kötü hakkında bilgi verdiğini kabul etmekle birlikte bazı şeylerin değerinin akılla bilinebileceğini iddia etmişlerdir. Çalışmamızda, Hayâlî’nin temel yaklaşımının Mâtürîdîlerin değer anlayışından yana olduğu gösterilmiştir. Fiillere yüklenen iyi ve kötünün anlamları konusunda Mu‘tezile ve Mâtürîdîler arasındaki benzerliklere dikkat çekilmiştir. İyi ve kötünün üç anlamının olduğu açıklanmıştır. İlk olarak iyilik, bir insanın fiilinin bu dünyada övülmesi ve ahirette ödüllendirilmesi anlamına gelir. Kötülük, bu dünyada yerilmeyi ve ahirette cezalandırılmayı ifade eder. İkinci olarak, iyi, amaca uygun olandır ve kötü ise amaca uygun olmayandır. Bu, aynı zamanda, iyinin yararlı olan ve kötünün de zararlı olan olduğu anlamına gelmektedir. Üçüncü olarak iyi, bir yetkinlik sıfatıdır ve kötü de bir eksiklik sıfatıdır. Örneğin bilgi, insanı yetkinleştirdiği için iyidir. Bilgisizlik, insanı eksik ve düşük bir durumda bıraktığı için kötüdür. Mu‘tezile’ye göre her şeyin iyilik ve kötülüğü akılla bilinirken, Mâtürîdîlere göre bazı şeylerin iyilik ve kötülüğü akılla idrak edilebilir. Bu bağlamda Mu‘tezilî ve Mâtürîdî düşünürler, sorumluluğu gerektiren değer bilgisinin kaynağının din olduğunu kabul eden Eş‘arîlerin argümanlarını eleştirmişlerdir. Makalede, ayrıca, tek bir cümlede doğruluk ve yanlışlığın birleşmesiyle ortaya çıkan yalancı paradoksu ile değerin kaynağı arasında kurulan ilişki ele alınmıştır. Yalancı paradoksunun bir çözümünün olduğuna inanan Hayâlî, bu çözüm üzerinden, Mâtürîdî değer anlayışının haklı gösterilebileceğini ifade etmiştir. (shrink)

This study aims at assessing the level of knowledge, attitudes, and practices (KAP) concerning reproductive health (RH) among adolescent college-going girls in the urban and rural areas of Chittagong District, Bangladesh. A college-based cross-sectional study was conducted among college-going girls (N = 792) of four colleges attending Higher Secondary Certificate (HSC) classes (eleven/twelve classes) in Chittagong District. Data were collected using a structured and self-administered questionnaire. Chi-square (χ2) and independent-samples t-test were conducted to make the comparison between urban and rural (...) participants. Data were analyzed using IBM SPSS version 24.0. The authors’ interpretation of the findings was also informed by anthropological as well as qualitative considerations. Mothers were reported to be the key informants of reproductive health for the adolescent girls of both urban and rural areas. Besides, urban respondents were more likely than rural respondents (p <.001) to feel comfortable during the discussion on RH with mother/sister/relative; to communicate frequently with their mothers; to discuss RH issues regularly; to have prior knowledge on menstruation. Moreover, this study also found significant differences (p <.05) regarding most of the items addressing RH knowledge, attitude, and practice between adolescent girls in urban and rural areas of Bangladesh due to the existing socio-cultural disparities between the areas of residence. Bu çalışmada Gilles Deleuze’ün Felix Guattari’yle iş birliğinden önce kaleme aldığı eserlere damgasını vuran Nietzsche okumasının anahtar kavramlarına odaklanılmakta ve Deleuze’ün Nietzsche alımlaması ile kendi fark felsefesi arasındaki ilişki açığa çıkartılmaktadır. Deleuze’ün okumasında öne çıkan temalar: Platonculuğun ters yüz edilmesi ve anti-felsefeye çağrı; nihilizmin aşamaları ve ahlaki değerlerin soybilimsel çözümlemesi; güç-istenci ve bedenin bir kuvvetler çokluğu olarak yeniden kavranması ve eleyici bir ilke olan ebedi dönüşün ‘kendinde fark’ı olumlaması şeklinde sıralanabilir. Bu konuların kesiştiği nokta Nietzsche’nin rasyonalizm karşıtlığıdır. Nietzsche, erken dönem (...) metinlerinden Tragedyanın Doğuşu ’nda, ‘Platonik İdea’nın ölü hakikatinin karşısına, kendini daima şeylerin oluşu vasıtasıyla yani görünüşün görünüşünde duyumsanabilir kılan varoluşun ‘ilksel birliğini’ koyar. Deleuze’e göre Nietzsche’nin felsefesi, yaşamın olumlanmasına yönelik anti-Platoncu bir başkaldırı niteliği taşır; çünkü o, “güç-istenci” ve “ebedi-dönüş” kavramları aracılığıyla görünüş dünyasına içkin dinamik ve yaşamsal ilkeleri, geleneksel felsefenin özne, özdeşlik ve temsil gibi kurgularına karşı savunur. Bu açıdan Deleuze, Nietzsche’nin güç istenci düşüncesini, bedeni ve dünyayı kuvvetlerin karşılıklı ilişkileri bağlamında yeniden yorumlamamıza olanak veren bir yaklaşım olarak değerlendirir. Ebedi dönüş öğretisi ise, bir yandan varoluşa içkin yazgıyı olumlayan, diğer yandan nihilist değerleri eleyen kozmolojik dönüşün şiirsel bir yorumudur. (shrink)

Hicri I ve II. asırlarda meydana gelen bir takım olaylar, Müslümanların düşünce dünyalarına da bazı tartışmaları beraberinde getirmiştir. Tartışmalı ortamın gerektirdiği sahih bir inanç sisteminin ortaya konulması, akâid türü metinlerin yazılmasına sebep olmuştur. Mâtürîdî ekolünde, Ebû Hanife (ö. 150/767)’nin Fıkhu’l-ekber’i ile başlatılan bu tür metinler içerisinde Hakîm es-Semerkandî (ö. 324/953)’nin es-Sevâdü’l-a‘zam’ı da önemli bir yer tutmaktadır. Bu metnin ayırt edici özelliği ise akâid eseri olmasına rağmen içerisinde birçok fıkhî meseleler barındırmasıdır. Genelde akâid metinlerinde özelde de es-Sevâdü’l-a‘zam isimli eserde fıkhî meselelerin (...) yer almasının muhtemel sebeplerini incelemeye yönelik olan bu çalışmada; Akâid ve fıkıh arasındaki sağlam ilişki, müellifin hanefi-matürîdî geleneğine bağlılığı, muhalif fırkaların görüşlerine tepkisel bir söylem ve dönemin güncel sorunlarına cevap bulma gayesi üzerinde durulacaktır. En reprenant dans son essai le principe d'Heidegger sur l'existence, N'Dré Sam Beugré a l'intention de préciser que la singularité de soi n'est pas une subjectivité fermée et isolée du monde, mais un être de soi ouvert aux manières des autres êtres, mais également ouvert au mouvement constant de dévoilement et de fermeture présent dans le monde.

Spinoza propose un nouvel évangile pour l'homme : la liberté et le salut. Ils conduisent l'homme dans la joie de la bonne nouvelle. C'est pourquoi, l'évangile de l'homme est un objectif prioritaire, mais ce n'est pas une fin directement poursuivie proportionnellement aux ressources utilisées. Pour le promouvoir, il faut mettre en place des conditions sociales, puis sa mise en oeuvre effective relève en partie de la sphère individuelle et se réalise dans une dynamique sociale où elle devient instrument et fin (...) des autres variables et des valeurs sociales. L'évangile de l'homme, à l'instar de l'augmentation de la puissance d'existence, est une fin en soi, mais, en l'absence d'une seule relation fonctionnelle, le développement des capacités peut être à la fois une fin, un moyen et une condition préalable à autre chose. Tout cela ne signifie pas que l'évangile doit être soumis à des compromis qui nient sa valeur intrinsèque, mais cela signifie que, pour se réaliser, une valeur sociale et individuelle aussi complexe doit entrer dans de multiples dynamiques pas toujours linéaires et pas toujours destinées au même but.
